These SMS Terms & Conditions describe how Open Pixel Studios, LLC (“Open Pixel Studios,” “we,” “us,” or “our”) may send text messages to individuals who choose to receive SMS communications from us. By opting in to receive text messages from Open Pixel Studios, you agree to these SMS Terms & Conditions.

These terms apply only to SMS/text messaging communications from Open Pixel Studios and are incorporated into our broader website policies, including our Privacy Policy and Terms of Use.

Under current FCC/TCPA guidance, businesses should honor reasonable opt-out requests and should not require consumers to use only one specific opt-out method. The FCC’s updated opt-out rules, effective April 11, 2025, require businesses to treat reasonable revocation requests as valid and honor opt-outs within the required timeframe.

8. Wireless Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

9. Eligibility

You must be the account holder or have permission from the account holder for any mobile number you provide to Open Pixel Studios.

By opting in, you confirm that you are authorized to receive messages at the mobile number provided.

10. Privacy

We respect your privacy. We use your mobile phone number and SMS communication data only as described in these SMS Terms & Conditions and our Privacy Policy.

We may collect and process information such as your phone number, SMS opt-in status, message history, response keywords such as STOP or HELP, timestamps, and related communication records.

We use this information to:

Send requested SMS communications, manage consent and opt-out requests, provide client or project support, respond to inquiries, improve our communications, maintain compliance records, and protect against misuse or unauthorized messaging.

We do not sell your mobile phone number. We do not share SMS opt-in data or consent status with third parties for their own unrelated marketing purposes.

We may share limited information with service providers who help us operate our messaging systems, website, forms, CRM, scheduling tools, automation platforms, or other business systems, but only as needed for those providers to perform services on our behalf.

11. Third-Party Service Providers

Open Pixel Studios may use third-party platforms to send, receive, manage, or automate SMS communications. These providers may process SMS-related information on our behalf.

12. No Sensitive Information by SMS

Please do not send sensitive personal information by SMS.

This includes Social Security numbers, financial account details, payment card information, health information, passwords, or other confidential information.

If sensitive information is needed for a project or business relationship, Open Pixel Studios will provide a more appropriate method for sharing that information.
